Registered sex offender restriction consideration

 

Over the past several months, articles have been published in the Sunbird News, website and email blasts in regards to considering some minor limitations on rental property. SunBird renters choose SunBird because they are excited to be part of a fun, friendly community with many social and recreational activities. Many current SunBird owners were once first renters, checking out the community before deciding to purchase a home in SunBird.

Over the past year, several SunBird residents have expressed concerns to the Board of Directors at almost every meeting about short-term and rental agreements offered on some properties located here in SunBird. In researching this topic, we also found Arizona legislation has changed recently to allow homeowner associations such as SunBird the ability to restrict high level (2 and 3) registered sex offenders from residing within the SunBird community. In order to enact this type of restriction, the SunBird CC&R’s would need to be amended by a majority homeowner vote with the proper legal restriction verbiage for enforcement. While considering the short-term rental and the maximum percentage of rental properties permitted in SunBird, this could be another item to consider for amending the CC&R’s to assist in protecting the lifestyle of our community.

At our upcoming fall meetings, the Board would like to finalize the wording for the proposed amendments to the CC&R’s. The next step would be to send a ballot to the membership on these proposals for vote.
